Can i still download this if so where windows sayed that it was no longer avaiable to download.

Microsoft shut down the downloads a couple weeks ago. So no, you can't get an 'Official' copy. It is still available on Torrents, though you should be careful

does it need a previous version of windows to install or can i install it on a formatted hard drive?

You can do either - Either a clean install to an empty drive/partition, or you can 'upgrade' an existing Vista install. (..or better yet: image an existing Vista install to a clean partition and upgrade *that*) If you have an XP installation, the upgrade option will not be available.
