I think I have something in my BIOS where I can disable it being written to - If I wanted to flash it I'd have to go in and change that option. Maybe it was a different motherboard I had though? Can't remember.

I imagine this could be a simple fix with a BIOS update coming up to add that kind of switch though, at least I'd hope so.

I forget what they're called but I had to clean this crap off my friends computer that isn't spyware but does kind of the same thing except if you delete it, it comes back. Getting rid of it was very difficult. You had to delete registry entries, folders, etc etc, and you had to do it several times or they would reproduce.

Who's responsability is it to stop this type of encroachment? Microsoft? Our routers?

the responibility ultimately lies with those who create such attacks, they should be responsible enough to not do it, but if they do i think it would be your mobo bios writers the update the loopholes in their bioses.
