OEM copies legal?

I've got 2 OEM copies of NT4, and was wondering- is it legal to sell them?

It's legal to sell used software with a used computer. Just gut a case and ship it with the stuff.

On ebay a lot of people sell it with a hard drive. 250-500mb "AS IS" meaning the hard drive may or may not work.
