I can certainly see World of Warcraft's concern over the issue. This guy is essentially teaching people how to cheat the game and he's making money off of it. It's one thing if you're posting or sharing ways to cheat, but I think it's quite another to profit from it. How is his book any different (on priniple) from a Pyramid Scheme?
On the other hand I certainly see this guy's complaint. He's not really infringing on any copyright laws.
I for one think "Lawyer Bots" are essential to eBay's continued success and survival. It's not feasible for a team of people to spend day and night searching for copyright violations and remove them. There are simply too many people trying to sell illegal things on eBay. eBay is required by law to take all steps necessary to remove copyright violations... and they're doing a damn good job of it.
Imagine an eBay with nothing but pirated DVD's, games, books, software, etc. It would not survive.
So you're saying that every single guide book ever sold about any subject should be banned or something?
And Ebay would do quite well selling pirated stuff, if the laws that made them liable for such things did not exist.

The markets around here are all full of the stuff, hardly a week goes by without a mention on the news of a £500000.00 - £2000000.00 haul of snide swag by dibble or customs. A guy got nabbed not long ago with 250000 fake viagra tablets. Nearly every pub sells cigarettes over the bar for £3.00 (shop price £5.00), someone simply forgot to pay the import duty when they mistakenly came back from France with a tranny van full of them.
That's if you're lucky. If you're not, it was made by dirty (literaly - they don't get the chance to wash often) asian workers in eastern Europe somewhere out of lawn-clippings.
I hate to break it to you Snorky, but you can get your hands on 50 packs of cigarettes for £75.00.(shop price £250.00) Of course they are the really dodgy Russian clones containing ridicules levels of cyanide. The ones I sel...buy at the local are brought in from France or Spain, I know that for a fact!

Well of course it would! But since such laws exist and AREN'T going to go away, so the point is moot. eBay could not exist if it allowed people to sell pirated works in TODAY's marketplace.

No. But try to appreciate World of Warcraft's position. If it was as easy as buying a frigin guide in a store (or on eBay) that told everyone how to cheat, what use would the game be to anyone? Have you ever tried to play Counterstrike with cheaters? It's completely retarded. This game makes it's money on subscriptions. How can it do that when there's someone undermining the system AND profiting from it?
I think if this guy was trying to sell a guidebook that was purely based on strategy (that HE came up with), it would be a different story. And if it wasn't a different story, then shame on eBay and World of Warcraft.
It wasn't a guide on software exploits and the like. It might be a bit dodgy, sure, but "tricks" and such are not exactly cheating - cheating and exploiting are very rigirously controlled by Blizzard anyway and couldn't really be made into a guide. (My friend got banned for something relatively benign, I don't remeber what exactly, but his server was controlled something strict.)
Some of the confusion may be because the article says this:

If there are hacks, cracks, and/or cheats, then I agree with WoW. If it is just a 'tips & techniques' book, then I agree with the plaintiff. However I can see WoW's point in several areas, and in those areas he may just be sunk.

The law should not differentiate things like content, anyway. If he did not break copyright law, he didn't. Undesirably functionality should be Blizzard's worry - you are, after all paying them $15 a month for it - not the governments.

No, but 1 yr law school, then realized I hated writing briefs (and researching the damn case law). Dropped out. Got an MBA instead.
