I bought a used IBM thinkpad at an auction. It didn't come with an OS. How
do I purchase this os?

You will have to contact IBM and see if yourThinkPad can even run on a
retail version of W98 and whether or not there are W98 drivers available for
it. If yes to both, check on EBay.

IBM doesn't sell os and I didn't think licenses were transferable? Is it
possible to obtain a license from Microsoft? ebay has pretty strict
restrictions on software sales for obvious reasons.

Actually, the OS that was originally installed on that ThinkPad belongs on
that unit for ever. OEM software is legally tied to the unit it was
installed on. Who ever sold it to you should have provided it to you.

Was it scrubbed clean or is the OS in C:\windows\Options\Cabs?
(That is where it was in this second-hand IBM Thinkpad 600e)

It was scrubbed. This laptop was bought at a state auction. It was used by a
state agency and, no doubt, scrubbed for security reasons. I'm glad it has a
hard-drive.
I contacted IBM. Their support guy suggested I buy win2000. But I'm afraid
that the laptop's puney processor and mem restrictions just won't run it.
any suggestions? If Microsoft no longer sells this, how can anyone on ebay
be selling it legally????

It's perfectly OK to sell a software license, provided that the original
license conditions permit it. Some OEM licenses specify that they are
permanently tied to the equipment they were originally supplied with, so
they can only be sold as part of a total hardware package. Retail licenses
can usually be transferred with minimal restrictions. One example is that
the seller must not have used the license as the basis for obtaining an
upgrade. Also, the seller must not continue to use the software, and must
supply you with everything, including documentation. If they meet the
license conditions, and you agree to those same conditions, it's all OK.

When we ordered laptops from IBM we specified out license and use our
company plan. This meant that the software couldn't leave the company wich
got around the OEM versioning. It could be possible that this is somethign
that happened and the original OS cannot go with the computer.

OTOH, it is probably were someoen has taken the licenses and sold them at
discount rates. Sure this isn't right but i have seen OEM versions of
licenses for sale. This is such an issue that microsoft won't let OEM
versions of software to be activated over the internet anymore. err at least
the one that dont need activated because of a bios identifyer or somethign.
