I have decided upon a Geforce 7600 Gt as it fits my budget. I am going to go with a Gigabyte GA-965P-S3 board with an c2d E6400 and 1GB of DDR2 800. I was looking at newegg and saw this:

and

do i have to go with the gigabyte model or does this make a difference. Also, i want to triple check that this is indeed the card i should purchase if looking for a geforce 7600 gt. Finally, does anyone have any alternative suggestions? budget leaves 120 -140 to spend

You can get either model; the 7600GT is good - the gigabyte one just provides passive cooling, which is nice & silent. I am using a BFG 7600GT to replace my faulty x1800GTO (if you get the x1800 make sure you have a backup PCI-E card to tide you over while you send it in for a month for repairs).

Yes - either will do nicely. The RMA process is a pain regardless of the manufacturer - hope you never have to do it.

Yeah, I guess it is always a pain - you lose you system if you don't have a backup part. Of the two I have used though, the x1800GTO was a much bigger pain. OCZ pays the shipping and you are down for 7-11 days while with sapphire, a month is estimated (mine has been out for 3 weeks now), I pay for the shipping to them and send them a money order for $30USD to ship it back to me. So I buy a faulty card, do all the troubleshooting myself (Sapphire's techs had nothing constructive to add & ATI doesn't help - as opposed to ocz's) and after all that I have to pay ~50USD to fix this card!
