I received an "Express Upgrade to Windows Vista" about two years ago through the Upgrade Redemption Program Microsoft had from the end of 2006 to the beginning of 2007. The DVD is a "Windows Vista Home Premium Express Upgrade," which I used to upgrade from Windows Media Center Edition 2005 on my newly purchased Gateway PC. On the disk, it says "For use only as an upgrade to a qualifying Gateway/eMachines PC." It is 32-bit.
My hypothetical questions are:
Can I use this DVD to install Vista Home Premium on a newly purchased Gateway PC with XP Home Basic, or does the computer have to have Windows Media Center Edition 2005, or will it just not install at all? This is with the assumption that the Gateway PC has the processing speed, memory, grapchics card, etc to support Vista.

I dont see how it would be illegal. If it will install is another matter, there is only one way to try
You can use the upgrade to do a full clean install of Vista. First format the drive and install the upgrade as a demo (this is automatic if you dont put the key code in). Once installed, re-install vista as an upgrade (this time putting in the vista key).
