Overclock settings doesn't seem to stick in the gigabyte 965p-s3

This is a weird problem with my gigabyte 965p-s3 rev 3.3 with my intel e4300. I have no problems setting the FSB from 200mhz to 266mhz at default voltage making the processor running 2.4ghz instead of 1.8. I would run games, encode video and the computer is chugging along just fine.

However, I shut off my computer and later in the day turn it back on. The computer was on for a second, turns off, then turns back on with the default 200mhz fsb running back to 1.8ghz. I had to hit the del button, set the fsb back to 266mhz to 2.4ghz and the computer will be fine again.

I assume there's a problem with the motherboard so I downloaded the latest bios which addresses the issue:

But it does not seem to work. Anybody know what can I do to fix this problem? Thanks.
