I don't plan on overclocking, I don't really play games at MAX settings, will this be decent enough to run games like, Universe at War, Call of Duty 4, Unreal Tournament 3, and other newer games that have come out?

Looks like a good build if you aren't going to overclock.

Also get the 8800GT 512Mb it is cheaper and performs better.

I would suggest the Cooler Master CM690 for a different case. (It has holes for 7 120mm fans, and comes with 3. (I think)

you forgot to add HDDs. You should go with at least one Raptor to help speed things up a little, Also go with a eVGA graphics card. You get a lifetime warranty and your card will also be good for their stepup program which allows you to use the card for 90days.If within those 90 days days you wish to upgrade to a faster card, eVGA will give you back exactly what you paid for your card and put it towards your upgrade. Its like getting to use a card for free for 90days.

Well then that would be backwards move, because I'm sure the 6400 will be able to outperform that processor. I like AMD and I don't see any processors by Intel for the same price that will outperform it. I have been looking all day. I could pay more and get a better processor but I don't have more to pay lol.
