WD2500 BEVS HD Tune Error Help....

I recently got a bare WD 250GB laptop HD and scanned it
using HD Tune 2.55. After initially having problem scanning
in an external enclosure, I decided to move to the docking
station and scanned again. The HD initially passed the Quick
Scan then I ran a detailed scan.
The detail scan indicated 1.7% damaged (8 red squares).
Is HD Tune reliable in terms of damaged HD? Is this HD toast?

This HD has a date of Jan 2009 manufactured date. Will I be able
to get some sort of replacement from Western Digital even though
I got this from a third party? Any idea and feedback is greatly
appreciated.

BTW, I use chkdsk on the HD and it indicated no bad sector?!
Why is this the case?

I think chkdsk only checks the sectors which are used so the damaged sectors may be on an unused area.
I would return the drive directly to WD.
