Getting Hot Swap to work on Gigabyte mobo

I have a Gigabyte EP35c-DSR3 mobo
I have installed Vista64 WITH AHCI enabled in the BIOS
after the install Vista found and installed ahci drivers from the web

It should work!
but it boots into vista and works for a few minutes (less than 5)
and then crashes sometimes a black screen sometimes a Bsod.

I cant re-boot as the disk is not recognised afterwards and I have to restore it from a backup.

has anyone got any idea's about this I have read a huge amount about similar problems but most are caused by the drivers being added after the Vista install at a later date.

Vista Ultimate 64
8gig dsr2 ram
nvidia 9800gt
samsung spinpoint 1TB drive permanently connected (used for Backups)
couple of WD 250gig drives that i can insert into sata drive carriages used for operating systems
i usb sata drive dock

I dont overclock

I use Shadow protect desktop for my backups which works great !
