i got a new q9400 on saturday just gone. the last CPU i got brand new was a P4 with HT so im going back some time. when i opened the new retail box there was no little black cover thing to safe guard the little gold dots underneith of the cpu! iv looked at the manual that came with the cpu and the drwings that show you how to install it has a drawing of that little black cover comming off and next to it it says (OPTIONAL)... just to be on teh safe side iv emailed INTEL and they say im correct it should have that cover? has any body else had this part missing from the packaging? iv not got my memory or grafix yet so i cant text it to see if it works

what are you talking about?
the cover for the CPU pins?
Try to check that CPU before it's to late to RMA

You really should do what ever you can to get it tested, because if you leave it and it dont work then you will have wasted your money.

Look at the pins carefully to ensure that they are all lined up. If not, you can VERY gently nudge them with a credit card.

Install the CPU, apply thermal paste (google how to do it correctly), heat sink etc.

Run ORTHOS to stress your CPU for a few hours.

i checked the pins on the motherboard they looked nice and clean, i checked the CPU and it looked perfect, my only worry is that normily when you get a brand new CPU it has like a little black bit of plastic clipped to the underneith of the chip then its normily in a clear ridgid plastic case.... when i opened this one it was just in the clear plastic case! thats it.... i checked the box before i opened it and every thing was sealed well
