WD My Passport USB 3.0....makes difference if connected to 2.0?

I recently acquired a WD My Passport USB 3.0 Does its actual transfer rate matches USB2.0 speeds limit, is this advertizemente justifiable?
Honestly, if the drive gives just a litle more over USB 2.0 maximum transfer rate, then it makes sense for me to conect it to a USB 3.0 port, even tough it falls far from 3.0 maximum

Have the WD USB3 1 TB drive and also a Samsung F3 i TB drive in a USB 3 enclosure - YES they are much faster when plugged into USB3 than USB 2.
