Ill be using this ONLY for gaming and i cant spend more than this. Also if I put in an ATI HD5670 with Phenom will i get more performance?

This would be the best choice but if any way you can get a none Intel board it would be even better the I3-530 is an extremely good overclocking CPU but Intel boards do not give much if any overclocking options. If you could get an ASUS or GigaByte board with this setup it would be perfect. But even still asis this will still be the best setup the I3-530 has proven itself to be a great gaming CPU on a budget but I strongly suggest getting a motherboard that will allow overclocking to get its full potential it is not uncommon for the I3 to reach 4 ghz without breaking much of a sweat and will be a killer gaming rig. Once you do get settled with your rig and you get a few more bucks saved up grab another 2GB of RAM making it 4 total to be the ultimate gaming rig on a budget.

If by any chance there are more options that you can get like the AMD Athlon x3 435 would even be a great choice and maybe be able to get a better GPU and 2 more gigs of RAM with money saved but if those are your only absolute choices the I3-530 rig would be the way to go.

+1^

Like SAAIELLO you could do better but if those are your only choices, I agree that option one will be better. What are you going to be using the system for?

1st choice is the best cpu, everything else looks identical though I only glanced over it. And no, pairing a Radeon 5670 with the Phenom II won't give you better performance, it's actually weaker than the 9800GT.

First choice is the best option for sure. The Core i3 is the best of the three processors there.
