would i be able to overclock the i5 3570k to any degree using the enermax ets-t40-ta to cool it?

what do you mean any degree? the higher frequency the more heat is being produced. aftermarket heatsinks benefit in load temps because they are bigger so they can dissipate more heat with your hot oced processor to keep it stable

Yes, if you have good air flow and thermal paste. And of course if your motherboard and psu supports it.

You should be able to OC that to atleast 4.2 GHz. Just make sure that you have enough room in your case to actually install it your case.

in case you havent found out yet that t40 beats the hell out of the 212 EVO should be able to without a doubt get up to 4.3ghz with completely safe vcore's and temps unleses your airflow in your case is absolute crap...still would put my money on it being fine though in either case.
