CrystalDiskMark uses highly incompressible data to test Read/Write speeds.

Benchmark with ATTO software and see if you get the advertised Read/Write speeds.
ATTO uses highly compressible data to test Read/Write speeds.

ok ive just done that and it says max read was 329 and write was 378 this is bit better but shouldnt it be running at the full speed have i missed a bios update even tho i cant find one anywhere or anything else? should it be a simple plug and play ssd? never had one before... cheers for help

No, how many times did you run CrystalDiskMark benchmark test?
Each test run Writes 20GB of test data at the default settings.
If you've run more than 3 tests in a row that could be the reason why your Read/Write speeds are low when you ran ATTO.

only did it the once but just tryed it again and it showing up to 300 read and write has dropped to 131

Log off (not Shut down) before you go to sleep tonight. This will allow Garbage Collection to run and recover drive performance.

Also, you didn't state whether or not the SATA port your drive is connected to is in AHCI mode. All SSDs need to be connected in AHCI mode for best performance.
