My hp pavillion dv5 1104ax crashed!! and i dont have a recovery disc

my hp pavillion dv5 1104ax crashed!! and i dont have a recovery disc.....so is the recovery disc that important? i mean i dont want my old data back...i will be happy if the new hard drive installs the new o.s and i can start all over again. my old o.s was vista...so is it ok f i install xp or 7 now??
