Defect cpu fan?

Recently i purchased a zalman cnps10x extreme to swap out for my old AMD stock fan. I had no problems during the installation and by the looks of things everything worked out just fine. But when i turn my computer on the cpu fan does not start up at all. Thinking it was just a small problem i rebooted the computer and then the fan worked fine. But here comes the weird part. Every time i let the computer stay turned off for more than 1 hour, the cpu fan will not start up unless i restart the computer or spin the fan manually with my finger. I have tried connecting my old stock fan back in to see it was a motherboard related problem, but it worked just fine. And i went into the BIOS to play around with some of the cpu fan settings in there to no avail.

What can the community at Toms hardware say about this problem?

AMD Phenom II X4 955 Black Edition
Gigabyte GA-890GPA-UD3H
Corsair Dominator DHX DDR3 1600MHz 4GB
XfX Radeon HD5870
Corsair 620W PSU

Looks like a dodgy fan imo, can you get replacement from supplier?
if the fan wires are a bit off/broken/lazy, the bios wont help anything,
nice rig though mate :)

Getting a new one should not be a problem since i have only had the fan for a few days.

But i feel like sending the fan back should be a last resort. I want to eliminate all other options before i admit defeat.

Sorry man, but I think other than replacing the fan at your own cost (maybe adding another matching fan for push/pull) its your only option :( ,
you've tried another fan and it worked ok, that tells me its the fan itself
