the full retail version with both Original CD's and manual , boxing etc.

CS, it should be okay to sell the Photoshop 5.0 (but then again, I am not a
lawyer). If not, then at least a no-cost transfer should be legal as long as
Photoshop 5.0 was uninstalled before the transfer/sale actually occurred.
On the other hand, using an older product to qualify for a discount/upgrade
version of the software (aka "the qualifying product" ) and then reselling
the qualifying product after upgrading doesn't usually comply with the
software license agreement--for example, owning Photoshop 5.0 and buying the
upgrade version of Photoshop CS at a lower cost than the full/retail
version.
Generally speaking, most software license agreements bind the qualifying
product to the upgraded product when an "upgrade" version is purchased at a
lower cost then the full/retail product. This also means both must be
sold/transferred as a single entity, otherwise, none may be
sold/transferred.
It all depends on the license agreement, which is why it is a good idea to
read them during software installation.

The ad never said it was used to get an upgrade, only that its a full
retail version of Photoshop 5.0. Nothing wrong with selling old
software.
That being said, as a buyer I would have checked to make sure that it
hadn't been used to upgrade, but that's buyer beware common sense. Lot
of folks throwing stones at this guy for no good reason.

Yep, that's how Adobe handles it, including a nice little transfer form
you can send in when you sell your old software off.

No, I'm pointing out that Bart needs to tighten up the straps on his
tin foil beanie a little. The kind of logic that says you can't trust
anyone because they're all a bunch of crooks is paranoid and
delusional. This guys got 673 sales in the past year with 100% positive
feedback. So even if you don't believe him, do you think 673 other
folks would take time out of their day to lie to you too?
If you are interested in buying a product you need to determine what
risk/reward ratio you're comfortable with.
If you don't trust this guy and want a copy of Photoshop CS, then go
buy one directly from Adobe for whatever ridiculous amount they're
charging. Nice and safe.
If you want a copy of PS 5 and think $170-something is a good price
then go for it. Pretty safe.
If you think that this might be a cheap stepping-stone to CS, then be a
responsible consumer and ask the right questions before bidding. Still
pretty safe, but you have to do some work.
And if you're too scared to buy what you want for the price you can
afford, then go away and quit bitching about what over folks are
willing to buy.

only upgrade the most recent version you have since previous versions have
