4670 Fan problem

I'll get right to the point, I just started overclocking my video card (which is a HIS ICEQ Turbo 4670), and the fan is staying at one speed, doesnt matter if its at 100% or 20%, it stays at the same speed, I checked inside with a paper too, its dead quiet and all but I want more performance, moreover I looked at my GPU temps and they are at 44c IDLE!! and load goes up to 65-70c which is scaring me, anyways, is the fan problem related to drivers or is it a hardware problem and I should RMA it?

65 - 70c under load is totally normal.... GPUs can handle higher temps than CPUs.

The fan speed could be a number of issues, likely the videocard's BIOS doesn't tell it to speed up until some higher temp.
