Low pings but horrible speeds/bandwidth

I have great pings 40ms to most places, but I have HORRIBLE bandwidth issues. I'm advertised to get 12 mbps, and when it's working correctly will almost get those speeds. But it seems like now I get sub 3 mps now and I don't know what it could be.

I have bypassed my router and still have the issue. I've had 2 tech guys come out and of course it was working correctly when they came and the first guy replaced the cable modem.

My modem is an RCA with a Model # of DCM425

Anyone have any ideas? This is getting REALLY annoying. :(

This is why I hate cable....it's a shared connection with your neighborhood. If your neighbors get home from work and decide to download porn at the same time you will get a massive drop in service. And the advertised speed is a maximum, not a guaranteed. For a guaranteed service you would be required to have a leased line(T1, T3) and then you would have a guaranteed speed.
