There isn't a huge gab in performance between the two cards and if you are CPU bound, or have high FPS anyways (60+) you cannot see a difference, since your monitor only displays a max of 60 fps unless it's a 3D monitor or an old CRT...

Thanks for the quick reply. My FPS runs in the 30's and 40's as best I can tell. How would I know if I am CPU bound? Its not a 3d monitor or a CRT. Thanks again.
A simple check would be to open up Windows Task Manager (ctrl + shift + esc), run your game and alt tab out to see if it is utilizing all of your cpu cores at 100%. Of course, some games are only designed to run on one or two threads, so you may not see even activity across your entire cpu.
And then of course you're welcome to mail me your old cards to replace my anemic 5750.
You shouldn't even be seeing FPS in the 40's with a 5870.With either the 5870 or 6970 your FPS should be well into the 100's.This is either a driver releted problem or a CPU related problem.
What is your full system specs?(Mobo,CPU,RAM)
What is the make/model of your Power Supply?
You were probably getting "1000" FPS anyways. Try playing a demanding DX10 or DX11 game and you should see benefit. COD, being a DX9 only game plays on "older" hardware just fine. It's not about how many FPS you get but how well or how bad the game plays with the given hardware.

I will play the end of Crysis where I would usually have to use an older version of DX for it not to stutter.

Phenom X2? Should probably look at a replacement. Or at least try unlocking and/or overclocking for now.
Could be PSU but I doubt it, 700W is significantly higher than necessary for the set up even if it's a *** PSU. Since you're replacing it anyway I'd try OCing the CPU and see if FPS goes up.
