Sapphire HD 5870 Crashing

Sapphire HD 5870 crashes on games that are NOT dx11. I can run games that are DX11 enabled for hours and hours and hours with no problem what so ever. However every time i run a game that is DX9 or DX10 i get the message "amd display driver stopped responding and has recovered" untill eventually the computer just restarts itself.

Asus M4a88t-V EVO/USB3 (with up to date bios via asus website)
AMD Phenom IIX4 BE
Gskill Ripjaw DDR3 1333 X8 gigs
Sapphire HD 5870 (latest catalyst & drivers)
Corsair 850W PSU
WD Caviar Black TB HD
Windows 7 64 (up to date)

Temps of Graphics card idle around 37C idle and 62C under load
CPU temps idle at 30C go up to 42C under load

I have all ready tried uninstalling graphics drivers, booting into safe mode using driversweeper then re-installing them. I have also tried doing a fresh install of windows 7 that didn't change anything either. It might be worth noting that i can run everything fine on Linux Mint with no problems so it def seems like a software issue of some sort. Any thoughts??
