What's the temp is BIOS?

sounds like you have a bad thermal diod or incompatable software. its not really a problem unless your over clocking because you will never be sure if the temps are accurate... after testing and you find its the cpu then best rma it as defective.
i would say test with multiple apps. as some are known to have issues with certain configs... like speedfan and the x58 cpu's if you use a x19 multi the temps read 10'c lower than what they actually are if you read em with other apps at the same time.

so yeah test with multiple apps like speed fan, real temp, core temp and hwmonitor. b4 you make a decision to return it.

ok so i downloaded hwmonitor under the amd athlon2 x 645 it shows all 4 cores at 17c but under the temp section it shows my cpu at 31c..im quite confused if in one section the cores are at 17c how can the cpu itself be at 31?
