Got a windows 7 but its not genuine and i want windows 8 pro

The upgrade is only available from a genuine, activated, copy of Windows 7.

the upgrade is available for genuine copy's of 7, vista, and XP. I'm betting your laptop came with a genuine (OEM) copy of one of the later two. reinstall the original OS and then upgrade.
