Refurbished MSI Motherboard?

I bought a supposedly new MSI board 2 months ago but when I got it the built in speakers aren't working but had no other problems hence I still decided to use it. Then last week its ram slots also stopped working so I brought it back to the store where it was bought. That's when I noticed that the manufacturer sticker at the back of the board dated to 5-2011. I also noticed that this model MSI H61M-E23 is now phased out. What do you think I should do? Although the store accepted to rma it, I still think that board was refurbished although I paid for a new one.

    I doubt that. What I will probably get is another refurbished unit. I only realized now that that model is already phased out. I bought it just because it was the only h61 board that has a pci on it that was available that time.
