Problem with Asus P8H61-MX board

Hi all,
I wondering if somebody can help with a problem that has arisen on my recent purchase of an Asus P8H61-MX USB3 Socket 1155 Motherboard.

I am having problems installing two sticks of DDR3 1333 Memory. (2X Kingston 2GB 1333MHz DDR3 CL9 DIMM HyperX black .

First off the PC will only start up if there is only 1 memory stick on the board. If I move the stick to the other slot or have two sticks on the board then it will not even get to the Bios splash screen. I have tested both sticks in the slot that works and both sticks work.

However the stick that works is identified as a 1033 MHz and is not being recognized as a 1333.

Does this sound like a Motherboard problem or do I need to configure the board in some way. The board is brand new so I should have no problem getting a refund or replacement. I just need to make sure that sending it back is the right thing to do and all options have been exhausted.

I would reseat the CPU and check the CPU socket for bent pins.
