6870's have worse performance in CFX????

Hello, First off I'll give my specs.
FX 4100 @ 3.6
2-Powercolor hd 6870 1gb @ stock
Asrock 970 Extreme 3
Viotec 1200 watt psu
4-2gb Kingston HyperX 1600 ddr3
3-Patriot Warp 32gb ssd Raid 0
1TB WD green
Antec 100 Ice case
Acer 24" 1920X1200
Logitech G13,G9,Attack 3

I have used drivers 11.10 to 12.1 with and without caps on fresh Os installs for every driver with no scaling.

I have also tested the cards by themselves in each of the PCI-E slots. Both cards are fine and I'm only seeing 2-5 fps lower in the x-4 slot on the mobo. I have confirmed CF is enabled. With CCC and GPU-Z. There is only one program showing improvement with CF. Unigine Heaven.
Average fps with 1 card is around 32 and with 2 cards 64. This is on the standard benchmark with no submision. All others show worse performance all the way around.

Tools used for monitoring
MSI AB
GPU-Z
HWMONITOR

I run the cpu and mem @ stock. I have OC'D to 4.4 and 1600 on the mem but still didnt help.
I have also used a 120gb seagate in a non raid just to rule that out as well.

Is There anything that I'm missing?

I have been a Bench Tech for 6 years and in the IT industry for about ten years. I have run CF and SLI set ups many times over with great success but I have run out of answers here.

Any help or Ideas are welcome and TY in advance.

i googled a bit and i noticed that viotek made list on one forum's 'brands to avoid' list. others agree.
about possible cpu bottleneck:

the asrock motherboard's 4 lanes in the second pcie 2 slot could be choking the second card when the cards are in cfx.

This was my thought and thats why I tested the cards single in the X4 slot.
The odd thing is Unigine is the only program to push both cards to 100% gpu usage in CF on all drivers?
All other games and 3D06 show about 30-50 % usage per card on all drivers.
While the cpu might be a BN should I not see some improvement instead of a decrease in fps?

1-uninstal ccc and caps using add/remove from control panel.,shut down
2-remove second card,restart
3-install latest ccc and caps,shut down
4-reinstall second card and restart.

DO not use a driver sweeper program !

let us know how that worked out.

No one was answering so I moved it here in hopes of more responses.

The X4 lane is not choking the cards.

This only leaves one thing and that would be the CPU :( 

Thanks for the patch Idea but this did not help. I tried it 3 days ago.

I should have spent the extra money on the I7 and just been done with it.
I'm a sucker for the under Dog.
