Isn't the HSF supposed to be spinning all the time? or does it only come on when the cpu gets hot??

it depends on the Motherboard , My Asus A8n-sli has Q-fan Enabled

When the cpu gets cold enough the fan will stop spinning

but only when its enabled in Bios

Some motherboards have an option to do this, but some do not. The DFI Lanparty has that option, so your cpu fan stops if it's under a certain temp, but some don't have that option. Having a nice cpu cooler makes it so that your fan is almost never on.
