DIRT 3 only gets 40fps?

just installed the game and am playing on my 7850. it gets a constant 40fps per fraps. i get 60 in BF3 so i know something is wrong here. is there a setting that needs to be turned off? the 40 holds completely static, doesn't go up or down at all. thanks for any help.

I tried and tried to get dirt 3 working even went from ati 6850 to nvidia gtx 580 and still the exact same problem. Every 3 seconds the game would pause for a split second then carry on again for another 3 sec then pause again. F1 2011 and dirt 2 work better than id ever expected so i got RBR for £1 on amazon and never looked back.

I'm not 100% positive but if Radeon has something similar to Vsync on Nvidia based cards I'd say shut it off for DIRT 3
