GTX 670 with stutters ingame

Hi,

I just got this new MSI GTX 670 OC edition and am playing primarily Diablo 3 at the moment, but the game play seems to be stuttering... With V-sync off I get 180 fps but some screen tear and with V-sync on there is this stutter. The card is only running at like 50% GPU power capacity in-game but I am wondering whether this is a driver issue or card related?

I have also ran some benchmarks on Batman Arkham City, also with some stutter...

Was just wondering if someone knew what was going on?

go here:
http://www.geforce.com/drivers
in the nvida control panel / manage 3D settings - scroll down and enable adaptive v-sync.

i believe that has helped others with the same symptom.

turn on vsync on diablo 3, i get stuttering if its off because i get fps in the range over 200 and it creates awful tearing. i've also heard to go to nvidia control panel and then disable adaptive v-sync and just use ingame vsync because there were some issues with Kepler's adaptive vsync. not sure though.
