You can remove one of the side fans on the case and use a Hyper 212 plus or evo cpu cooler ($20-$30). The side fans are not really needed so you can take one or both off and use them in other places thus freeing up room for a better cpu cool ( much more important).

If i remove the topfan it will stop putting the heat out of my case because my cpu heat sink is about 2inches maybe less from my top fan and a inch or so from my ram

Ok so you have room to fit the Hyper 212 plus/evo in there and shouldn't need to move anything to make it fit. The only issue you would of had would have been if you had side fans in, the Hyper 212 is tall and the side fans would have been in the way most likely. The ram and top fan should not be an issue.

So what your saying is the evo is just tall not wide and do you have a link to it?
