CPU clip/cover causing short

I'm building a brand new system and I've built several computers in the past. It's an i7 3770k and Asus P8Z77-V motherboard. I'm running into an issue I've never had before. After installing all the components and flipping the power switch, the computer turned on then immediately off. Checked all my cables and everything seemed ok.

After more trouble shooting and unhooking every component, I eventually found that when the clip that holds the CPU down is covering the CPU, the short occurs. If the clip is up, the computer will turn on.

Any ideas? Is this a bad CPU?
