MSI Lightning 7970 faulty?

I am afraid that my brand new lightning is faulty, but wanted to check back with you guys before sending it in. My System:

CPU: i5 3570
Board: Gigabyte GA-H77M-D3H
Memory: G.Skill Ripjaws 8GB DDR3 1600 CL9
Case: Silverstone RL01B ATX Mid Tower
PSU: Thermaltake Litepower 700W
Seagate 2TB Barracuda Sata3

Graphics: MSI Lightning Radeon 7970

Also on the Board:
TP-Link 150Mbps PCI wireless lan card
Creative Soundblaster X-Fi (noticed to late that I need an optical S/PDIF T.T)

Catalyst: 12.6
Overdrive: active (925/1375)

1) As soon as I start any game, the fans of the card get loud. And I mean DVD drive spinning on highspeed loud. I thought from reading the reviews it should be quieter..
2) Temperature: Starcraft 2, Ultra Detail 1920p -> 96 Degrees Celsius!! The same applies for any other game I tried that utilizes the card
3) Graphics errors: Cant play Rage without constant graphics errors, the picture turns sporadically into an LSD-trip of colours

I did run a 3Dmark11 extreme test and got a combined score of 3070, which seems to be within expectation.

I first thought the temperature problem comes from the fact the wireless card is exactly in front of the MSI card, but removing it did not change the temperature at all.

Question: Is the card possibly broken and should I send it in?

yeah 96C is extremely high for a Lightning II. Something is wrong and it should be replaced
