It's seems that Newegg is theeee spot for loading up on hardware. But it appears that have a harsh and unreasonable rule for software returns. No exceptions, no returns, even if your disc showed up physically faulted due to manufacturer or shipping errors. That's just stupid. We'll take your money and ship you the product but no guarantee as to it's condition when it gets there. Really? Screw that!

So I saw WalMart has W7 Home Premium for $100, for the same OEM and you can get a warranty with it.

So my question is, would this be the best choice for my new build or am I missing something here?

There policy on software is completely understandable.

The key is the only part of value with 99% of software. The media you can download, but the key is unique to buyer.

It takes a few seconds to note down the key and its impossible for anyone to know you have. Same reason you can't resell computer games.
