GT 440 Doesn't use all of it's power

I bought a brand new GT 440 1GB GDDR5, but it can't use all of it's power. When I play games like Max Payne 3 and Battlefield 3 the video card doesn't use all of it's power. Instead while playing it use only ~45% out of it's total 100% and that causes the game to lag. The video card doesn't use all of it's power. I think the problem is in my PSU. It is old and it's chinese and we all know how chinese PSU's work it's 350W. Also when I tried running BF3 and Max Payne 3 at medium then low and then high settings the difference in FPS was 2 FPS. I am serious 2 FPS and it is not lower for example if on medium settings i have 25 FPS on high I have 27 FPS instead of lowering it increases that is really weird. So what is the problem and how can I fix it ?

buy a new psu and if that doesnt help rma your card
also update all your drivers mobo,video , sound etc and see
