about once a week when i start counter striek and i try playing i can't crouch. i go to the controls settings and there is no command set for duck. so i set the defaults and everything is ok. but the problem is that i have to set defaults about once a week, why do the controls keep getting messed up?
also, most of the time my fps is around 85 in cs. but about every other time i start up my computer and play counter stiek the fps maxes out at 60. restarting the computer fixes this but it's a pain in the ass. any sugestions for either problem?

Nope- but it's probably just a windows quirk.

Check your config.cfg file in your CStrike folder. See if "duck" is bound to a key. I saw this problem at a LAN party once. I made the person's config.cfg file read only for the binding to stick & it worked. But you can forget about making any cosole changes as this is a very short term fix of course.

Did you try the official Couter-Strike forums? I would reinstall Half-Life & CS & apply all necessary updates too. Then update (or reapply if you already have the latest) your video card drivers.

Also, this may sound kinda crazy, but reapplying Service Pack 2 may help if you're running Win2k. I know its got nothing to do with your problem, but doing this has cured some really friggin weird problems for me in the past.
