Need Advice on plan change rules

I had changed our plan in December 2002 to get new phones and more minutes
with a 1 year agreement. I was very happy with the new phones and the
additional time. Last November 2003 we found that we were running over
minutes on our plan due to family illness. Me wife contacted C/S to upgrade.
We went to 700 minutes from 500 minutes and added PCS 2 PCS for free . When
my wife told me about it I called Sprint PCS to get the details on the plan.
I was then told we were required to fulfill a 2 year agreement. I decided
that the commitment of 2 years was not worth the added minutes. I asked how
long we had to reverse the change. The C/S person said we had 14 days. I had
my wife called and cancel the changes.

I had enough of the reception and billing difficulties and decided to
change providers due to the fact that we can keep our number. Now I receive
a bill with a charge of $150 X 2 for $300 early cancellation. Frank W. the
C/S supervisor told me that since we were customers since 1999 we were not
entitled to the 2 week period to change our mind. That he could only give me
an address to contact to further dispute the $300 charges.

Now we have no way to check on policies regarding this change as our
account has been closed.

Where should I go from here? Any help would be appreciated.

Yup, we had osiris confess that thats not what the rules are but he
always put people in new 2 year contracts anyway.

Write to your State's Attorney general with a certified copy to SprintPCS
in KC. A typical example of SprintPCS being customer unfriendly. And
since the $300 is in dispute don't pay them.

Hmmmm- I don't see anything about any dollar amount in dispute- Ritalin
running low again?

And before you have a hissy, if you are talking about the ETF, there is no
mention that the phones have been deactivated. You can't withhold payment
based on a charge that hasn't appeared on your bill- withholding $300 from a
bill that shows only correct charges will result in deactivation of the
phones and a slow pay notation on your account (not the best thing to have
at retention time). And Sprint will be well within their rights, the law
and the Service Agreement to do it.

Gee Phil- I would have thought that your lawyer/son would have explained
that to you. Or is it a case of even he realizing what an absolute moron
you are, too?

Too late- I beat him to it last week when he subjected me to his 'naughty
word' count. I told him he forgot to count the "m" word. Kind of

know. Apparently, there's quite a file full of complaints, and they are
very willing to listen to a longtime customer (1994). And, they seem to be
willing to contact your ISP as well. Bob may not have had any luck, but
I'll bet they carry a little more clout.

I happen to know the guy in charge of the Abuse desk at Earthlink - was
actually talking to him about taking a job at Earthlink's Pasadena facility
(decided not to, it's too much of a commute from Apple Valley, and gas is
ridiculously expensive here). I'm going to ask him for a clarification of
ELN's policies on morphing - as always, it's not the trolling I care about,
it's the morphing that I consider abusive.

First of all, I didn't say that even approximately. I *did* say I'd
sold customers on the value of a 2 year agreement.

Secondly, for PCS2PCS to be free, a 2 year Advantage Agreement *is*
required. Without that agreement, PCS2PCS is $5/month (since the
plan being discussed is a shared minute plan, that $5 covers all
phones sharing the minutes).

This has been a *very* interesting question. And I wonder
just how much this newsgroup spawned this little debate. I
had a woman challenge me on this tonight. So I had the
PERFECT opportunity to find out, once and for all. And,
wouldn't you know? I found out. Much to my chagrin:

I found the following question answered in our procedures
database:
"Can an existing Individual Purchased customer swap service
plans without needing to renew their contract?
Impact of Service Plan swaps to Contract Plans on
Individual Purchased accounts.
LOBs: Business Services"

Now, this is, once again, specifying Business Accounts.
Still, I would imagine, in this case, that Consumer
Accounts are much the same. And the answer?

It turns out that a plan change does not require a new
Advantage Agreement if 3 conditions all prove true:

1. The customer is eligible for the new service plan,
AND
2. The new plan is in the same family of plans as the
existing service plan (for example, switching from one Free
and Clear service plan to another Free and Clear plan), AND
3. The new plan does not require the current service
contract to be renewed. See related solutions for the
specific plan the customer wants to switch to for details.

That "family of plans" condition seems to me to be the most
complicated condition. Remember when F&CA was sold as its
own family? Now moving to a plan where it's just an add-on
means renewing the Advantage Agreement.

Anyway, complications aside, I was wrong. I guess I've
been able to get away with justifying the new agreements
all this time. Like 2 year Advantage Agreements for the
7PM option, or PCS2PCS. Stuff like that. This woman
tonight wanted none of that, and she was right.

This has been a *very* interesting question. And I wonder
just how much this newsgroup spawned this little debate. I
had a woman challenge me on this tonight. So I had the
PERFECT opportunity to find out, once and for all. And,
wouldn't you know? I found out. Much to my chagrin:

I found the following question answered in our procedures
database:
"Can an existing Individual Purchased customer swap service
plans without needing to renew their contract?
Impact of Service Plan swaps to Contract Plans on
Individual Purchased accounts.
LOBs: Business Services"

Now, this is, once again, specifying Business Accounts.
Still, I would imagine, in this case, that Consumer
Accounts are much the same. And the answer?

It turns out that a plan change does not require a new
Advantage Agreement if 3 conditions all prove true:

1. The customer is eligible for the new service plan,
AND
2. The new plan is in the same family of plans as the
existing service plan (for example, switching from one Free
and Clear service plan to another Free and Clear plan), AND
3. The new plan does not require the current service
contract to be renewed. See related solutions for the
specific plan the customer wants to switch to for details.

That "family of plans" condition seems to me to be the most
complicated condition. Remember when F&CA was sold as its
own family? Now moving to a plan where it's just an add-on
means renewing the Advantage Agreement.

PCS to PCS is free with 2 years and shared minutes. Otherwise they're
currently $5/month each.

PCS-PCS is free on all 2-year agreements. 7PM is a $5 option on 2-year
agreements ... one I pass on. If you don't go over your minute plan
with 9PM nights, why would you bother to pay for 7PM nights ... so you
can talk MORE?
