Ok. I just moved out of an apartment that I have been living in for the last 3 months. The damage deposit was $425. It was an old house.
Before we begin Id liek to say taht I only took this place because I was stuck and there were no other place available that I coudl afford.
The place was a dump, bathroom and kitchen faucets were either dead or leaking, the toilet was broken, and the closet in the bedroom was covered in mould. IT also took the incompetent dumbass 2.5 months to get me a mailbox key.
Before I moved in, the landlord painted the bathtub lining with latex paint and put some new caulking down. The tub lining is old and rotten. After two weeks, the mould came through the tub lining. Because of the other thigns that were broken, the landlord was coming and going all the time, sometimes while I was sleeping (I sleep in the morning because I work evenings) for the first week. After ruining my sleep for a week and he got the faucets and toilets fixed, I said screw it, im tired of this, ill just tolerate the bathtub because im only gonna be here for a month or two.
Now that I am moving out, they are saying that they are going to take some or all of my damage deposit because of teh mould. All the landlord did was paint over it before I moved in. Its not like its just mould on the outside taht can be scrubbed off, its coming from behind the tub lining, like theres water damage. I asked a friend who was in a similar situation, and she said that because I left it and didnt tell the landlord, I might be at fault.
Does this sound accurate to you, that it might be my fault? Man I am so pissed..

Depends on how far he will listen to you, the ball is in his court, since he has his money.
To fight it will take your time and more money.

Dead simple, put an ad in the same place you found his. Yours should tell what a twat he is. When you get the cash back(plus ad costs) stop placing the ad.

I just signed/renewed my lease 5 minutes ago. In it was a clause about mold. Basically it said that it's my responsability to work with the landlord to get things taken care of should mould be a problem. I also need to maintain an apt that is non-conductive to mold.
By not working with the landlord you probably did take on the responsability for the damages.

does the landlord have your bond, or does the government have your bond.
here the government takes ALL bonds and the landlord has no right to it untill its agreeed by both parties that it is to be returned or taken.
you have a tenancy tribunal to sort out these disputes?
my parents are landlords here, and as a landlord they would have no right to keep the bond for a situation like that. but if they thought they did have a right to the bond and the tenant didn't it would need to go to the tenancy tribunal to sort it out.

When I was living in an apartment, I took pictures of the problem areas just in case. Luckily I never had to go through what you had to, so I didn't have to use them
You should've repainted the bathtub lining before you moved out, because if you had told him about it thats all he would have done, and returned back to him some of his sorry a$$ed maintenance practices, you can always go to small claims court but you have to prove your case.
Heres a tip for you as long as you're renting from a landlord, before you move a thing into the house or apartment, have at least one witness with you, take a camcorder with sound and date/time stamp capability, walk over all the property you're responsible for, go through every room of the house or apartment, video walls, ceilings, floors, specifically any carpet stains, or mold and mildew, and video document what it looks like, if you see something wrong like a doorknob busted through a wall, take closeups and make an audio comment about it, put that tape in a safe protected place, like a firebox or safe deposit box. Do the same thing when you move out after you've cleaned up everything, those tapes can save you from a lot of trouble, sometimes even the worst of the crooked landlords, will regretfully give you your deposit back, if you let them know you have video tapes of the property before and after and a witness.
I had a landlord once that was almost laughing in my face at the prospects of having to give me my deposit back, I had actually done some repairs on the place and was leaving it in better shape than it was when we took possession of it, but when I told him I'd see him in court and that I had made a video walkthrough of the property, with witnesses just in case he decided not to give me back my deposit. You could hear his voice change instantly, I got the deposit back. If your landlord turns out to be an a$$, be more a$$ than him.

We put up 20 people into a crappy apartment, and split them into two teams, landlords and tennants. they battled it out to gain immunity at the Tenancy tribunal. stay with us to see who wins the $1 millon bond.

na to be serious though. its a "legal requirement" to do a property inspecition (like 4ryan suggested) and get it signed by both the landlord and the tenant, this as well as the Bond gets sent to the government (stupid socialists eh??) who then holds onto it. the bond can be transfered to a new flat. or returned. if there are any disputes between landlord and tennant, they just pull out the property inspection, and take a look.
we actually DO have a reality tv show here about lots of this stuff. its really good entertainment. its called "renters" a really really bitchy property manager woman is on it. its a good laugh seeing her dominate her tennants who are being sloppy.

I went over wth some bleach and water and made a 50/50 mix, and scrubbed the lining. 95% of the mould came out.. It was great!
So yea, the landlord is happy now, and all it required was a little effort on my part. Im glad i put the effort forth instead of flying off the handle, because it worked out well for everyone
I am DEFINATLY taking picture next time tho. Well, I just moved into my current apartment so im going to get a camera and snap some photos because altho its a MUCH nicer place, it is still an old building and you never know what could get broken.

We have a government agency called the "Rentalsman". My damage deposit is handled by them... I think its a great idea, makes it safer for landlords and tenants alike.
