9500 pro and Splinter Cell

I'm just wondering about my card's performance in the Splinter Cell demo. I get about 20 fps max. The weird thing is that fps don't change when I go from 1024 x 768 max details to 640 x 480 low details. Also, when I chance direct 3d and opengl from "optimal performance" to "balanced", I get better performance. I have a 1.7 p4 and 256 megs of pc 133. I know my ram is crap, but what could be going on? Shouldn't I be able to play this game and min resolution and effects? Thanks for any help.

Could be the game needs a patch. Could be drivers. E-mail them and ask why it doesnt work its a demo.
