How did Club 3D escape the wrath of Futuremark?

Someone explain what is going on. Does this mean that Club 3D doesn't follow spec, Futuremark has a bug, Inquirer is stupid, or Futuremark is cheating?

Still doesn't explain much other than to say it may be optimization free. I would have liked to have seen it's benchmark results against other FX5700s, since this may just be that buying the Club3D version means no run-time compiler in their current drivers (which may be based on an older version).

hmmm is it just me or do i think FX5700Ultra has a different design than the current NV3Xs. Cause it's definately not an speed boost from 5600Ultra. It' something new IBM and nVidia cooked up. I have great expectation in this card. :D
