Just spotted this article on one of my favorite gaming news sites:

A legal handheld NES?!? Very cool! And now available to customers in
the USA. Have any of our European members tried one of these things?

I don't see anything in that "press release" that says the item is legal. I
still want one though :-p

Well, if it doesn't include any built-in pirated games (does it? I'm not
sure), then it's probably a little "less illegal" than the other portable
famicoms I've seen.

I figured if they're being so open and (relatively) high profile here,
then they probably weren't illegal. I admit I'm making an assumption
here, but these guys have to realize they legal risks they are taking,
and they must be pretty confident to take on Nintendo at this stage of
the game (right after so many other Famiclone all-in-one devices have
been barred).

AFAIK the production of Famiclones isn't illegal since the original
Nintendo used off the shelf parts available to anyone. The packaging
with rom images is the illegal part.

If Famiclones were illegal I'm sure Nintendo would be sueing the direct
to TV units right now. I'm not sure about a lot of them, but I know the
Intellivision DTV unit is a NES-on-a-chip.
