As most of our readers know, I am a former Senior Editor of THG. I quit in December, 2000 for reasons I have not yet publicly disclosed.

Well, whether you like Van Smith or not it's still wrong for THG to change the bylines. He should get credit for the articles he wrote or helped write.
For one thing, he posts stuff with no proof (Athlon JPEG error, a la GordonFamily.com), and spends most of his time attacking other websites instead of just leaving well enough alone.

The door of slander swings both ways then if else, what Van is doing is not slander in itself. He sounds like a bitter man.
I know in most businesses there are contractual agreements signed by employees concerning intellecual property rights, i.e., at my job I distinctly remember signing an agreement that specified something to the effect, that if I developed technology on the company's premise that the company owns rights to the invention.
So, little do we know of the agreement between Tom and Van to even agree or disagree. I tend to steer clear of bitter people...it is contagious.

Yes, I compared the two legal statements and they are slightly the same, except for the name change of the business, but during the same time period. In a court of law I sincerely believe Tom would win.

I had by far the highest level of output of any editor working there during that time.
Some of my articles had profound industry impact including my exposes on Rambus RDRAM, which disproved performance claims maintained by Rambus and Intel for the Pentium III implementations of this memory technology.
As chief liaison between THG and Intel, I also played a critical role in the recall of the 1.13GHz Pentium III.
Quite a few claims there.

I wonder if he also gripes about how his ("We parted for reasons which I'm not prepared to disclose" ) leaving THG, gave him the chance to create his own site. Did he get sacked?

If a person's work is good, then the work speaks for the person. If a person has to speak for their work, then their work speaks nothing for the person, because the person has already robbed themself and spoiled the work. Something like, "pride goes before a fall."

Interesting . . . I have searched for the files he speaks of, and it seems that they are nowhere to be found. Since I am here more for the community than the articles, I do not have any information concerning the possibility of their original existence.
Whether or not "slander" has been committed, there is no "evidence" currently in existence except for what the plaintiff has stated. This results in the age-old "My Word Against Yours" type of argument. In the court of public opinion, the evidence considered in these types of cases are usually past discretions/indiscretions. In this case, this information is "out there" for everyone to see. And, as lawyers love to say, "The evidence will show . . . "
I am sure that most of you would agree with me when I say that sometimes, for the sake of <b>valuable diskspace</b>, there exists the need to purge information which may now be outdated, especially when such information is stated by individuals which have shown tendencies towards embellishment and self-gratification.
But then again, I wouldn't know about that, would I?

Why? Van was in the employ of THG at the time that he wrote that article, and as such, it is the intellectual property of Tom Pabst ie Tom's Hardware Guide.

Oh, which brings up a point about the integrity of Mr. Smith. Isn't he the one that ran more than one article about the CD Key generator for Windows/Office/Visio XP and stated that he successfully registered and activated the software using these pirated codes? Sounds like piracy to me, what do you think?
