I have a windows 7 pro cd but requires a pre-existing licence, as the cd is windows 7 pro and computer has vista home premium would the upgrade still work?

You cannot upgrade from Vista Home Premium to 7 Professional, you'd have to perform a clean install by booting from the disc and selecting clean install during installation.
