Size compatibility of HTPC and CPU cooler

Another first timer here - any advice appreciated.

I'm looking to build a SFF/HTPC system to use as a desktop pc*. I think I've settled on the case (Silverstone ML06b) and most of the components but am having trouble checking the compatibility of things, size wise. The silverstone website says the cooler height is limited to 50mm when used with the optical drive (in the manual) but putting parts together on http://uk.pcpartpicker.com/ it's giving me a compatibility problem between the case and the cooler I'd chosen (Scythe Kozuti SCKZT-1000) even though its height is given as 40mm. Is there another limitation that I'm missing?

Thanks, and any other things I might have forgotten would be gratefully received.

*not going to be used for gaming - main use will be photo editing and programming + standard web browsing and media stuff.

It says this at the silverstone site,

Limitation of CPU cooler
37~70mm

Maybe the real hight limitation with a dvd player?

The manual (pg13) gives

Bracket removed = 70mm
2.5”HDD,9.5mm thick = 55mm
Slim optical drive = 50m
3.5”HDD/12025 fan = 37mm

Is this just pcpartpicker taking the minimum value for its compatibility check?
