Gigabyte GTX 970 Display Driver Crashing and then recovering

Doing a search pulls up very old threads that no one has found the issue for this particular problem.

Specs -
Asus Maximus Formula ROG motherboard
i7-4790k
16 ddr3 ram
GTX 970 Windforce
850w psu

This computer was built 3 days ago, and even before it was built I've been having issues with this particular card.

Nvidia wanted me to change some setting and some 3d stuff but that didn't help. I did a clean install of the drivers (especially with a brand new build and OS). Updating to the latest drivers as well.

Any things you guys can suggest before I RMA the card?

This is usually a corrupt driver, down load it again delete the old one and install the new one.
