Backup Restore Licensing

I am wondering, if I have a server that is running Server 2012 Standard OEM. If my server crashes, and I restore it from a backup that was made with N-able Backup Manager, in a completely new server, new MB, CPU, etc... would I have to buy a new Windows License or would it be ok to use the original license? Legally, or able to do it at all.

Microsoft OEM Software Licensing: Rules and Restrictions state:

Motherboard upgrades or replacements require a new operating system license with an identical series motherboard (unless a replacement is for a defect).

Just to clarify, to make sure that I understand that correctly, you cannot use the OEM license when you restore to a new server, but if you are lucky, Microsoft will make an exception, and let you reactivate it?
