Well, it depends on whether there is a new bios and according to you, there isn't.

In cases where a card this new is introduced, it can sometimes be a large factor. I have had cards not recognised before without a bios update on older hardware. So that may well be a factor. Unfortunately, without access to a newer bios, we may never know.

Just see how you travel, and if you continue having issues, start saving up. That rig has gone the distance.

i use a microlab m-500 speaker for sounds when gaming
so far i havent encountered issues when i disabled kboost on evga precision x
i think the old components are the problem
will upgrading the bios for my mobo fix some issues? problem is, i cant find a bios for n61pc-m2s biostar

I am surprised that motherboard has PCI-E 2, that makes things much easier for you. I was wondering whether it had PCI-E 1.1 which is why I brought it up.

Is it only Batman where you get the sound issues? What do you normally use for sound?

I ask this because I have seen Nvidia sound drivers (that come with the Nvidia gpu drivers) cause issues and replace other sound drivers after installation. It is simple to change them over again, but thought I would put this possibility out there.

unfortunately i dont have another pc to test it with
i downloaded the manual for the mobo and it says PCI Express GEN 2 x16 slot
i think its the other old components thats making the problem
so,
should i still return the card for replacement?
BTW
i was playing arkham asylum on high settings 1440x900p
and it's sounds STUTTERS

PCIE 2.0 and 3.0 doesn't really matter that much for gpu since the bandwidth isn't saturated yet.
It's more down to the other hardware fault's like the ram and the cpu. 2GB is probably not enough.

Would that rig support a PCI-E 3.0 card like the 750 ti?

It be interesting to see how things go with that setup. As Suztera has said, that is an aging build there. I would have thought the CPU would hold the 750 ti back quite a bit, but then again, my old backup socket 939 4800+ rig can still game and it has a 5670 1gb gddr5 paired with it.

For about 1335.60 (i think) more pesos you can get the radeon R9 270 witch is better than 750TI. but im in america so i dont know how much you make or any of that but thats my 2cents. if not the EVGA mentioned above is the best of the 750Ti's

EVGA currently is the fastest with the FTW with ACX cooler for GTX 750Ti.
